Terms and Conditions.

 

These are the standard Terms and Conditions on which we will supply you with our event management services (“the Services”).  Please read these carefully before ordering any Services from us.  By ordering our Services, you agree to be bound by these Terms and Conditions.

1. Information about us

1.1         Ashton Leigh Vian trading as North Norfolk Concierge is based in Langham, Norfolk.    

1.2         North Norfolk Concierge does not hold any property interest in the venues provided for events but merely acts as agent for the customer making the booking (“the Customer”).  The provision of Services is a contractual relationship directly between North Norfolk Concierge and the Customer.

2. The services

2.1         North Norfolk Concierge shall supply services of any, and/or all of planning, preparing, managing, and catering for weddings, dinner parties or events and supply of other services in relation to it. 

2.2         North Norfolk Concierge can, on the Customer’s behalf, negotiate contracts with third party suppliers (“the Supplier”) for the event, including but not limited to, marquee hire, venues, florists, caterers, and bar hire.  North Norfolk Concierge will take reasonable care in the selection and negotiation with such third parties.  All contracts negotiated with the Supplier will be entered into between the Customer and the Supplier directly and it will be the Customer’s responsibility to ensure they are aware of and comply with the Supplier’s Terms and Conditions.  

2.3         North Norfolk Concierge will not be liable for any non-observance by the Customer of any Supplier contract terms.

2.4         North Norfolk Concierge will not be liable for the performance of any Supplier and cannot accept responsibility for any failure of or unsatisfactory performance by the Supplier.

2.5         North Norfolk Concierge does not purchase goods or services on the Customer’s behalf, save for catering items. 

3. Tastings

Tasting services are complimentary for small groups and charged for larger groups.  Availability, numbers, and prices will be dependent on the Supplier’s terms and conditions.

4. Minimum numbers

North Norfolk Concierge reserves the right to set minimum numbers for guests attending an event or catering for selected menus.  If numbers fall below the set minimum, a charge may be applied and will be advised by North Norfolk Concierge.

5. The contract    

5.1         Bookings should be made by the Customer via North Norfolk Concierge’s website,  ‘Contact Us’ form or by telephone or email to the number and address provided on the website.

5.2         North Norfolk Concierge will confirm details of the booking to the Customer via email and will provisionally hold the agreed date of the event for 10 working days.

5.3         The Customer will accept the booking details and Terms and Conditions by email reply to North Norfolk Concierge by the 10th working day after the booking was made and the contract between North Norfolk Concierge and the Customer (“the Contract”) shall be entered into.   

5.4         The Customer will need to confirm final menu choices, event numbers, and any special requests at least 20 working days prior to the event. 

6. Price and payment   

6.1         Unless otherwise agreed by North Norfolk Concierge in writing (and subject to clause 9 below) the price for the Services shall be as set out by North Norfolk Concierge at the time of booking.

6.2         A deposit of 40% of the Contract price shall be paid at the time of agreeing to the Contract (set out in clause 5.3 above).

6.3         30% of the Contract price shall be paid two months before the event date.

6.4         The final payment of 30% of the Contract price shall be paid two weeks before the event date.

6.5         A deposit of 70% of the Contract price shall be paid if the event is less than two months from the booking date, and the final 30% shall be paid two weeks before the event date.

6.6         Full payment of 100% of the Contract price shall be paid at the time of booking if the event is less than one month after the booking date.

1.7         The price of Services excludes VAT. 

6.8         If payment is not made on the due date, North Norfolk Concierge may suspend the    Services until payment of all arears is made.  If money is outstanding for more than 14 working days, North Norfolk Concierge may terminate the contract without compensation to the Customer. 

6.9         Deposits and payments to third party suppliers (the Supplier) may vary, and will be entered into directly between the Customer and the Supplier in accordance with clause 2.2.

7. Cancellation   

7.1         Once the Contract has been entered into, it can only be changed or cancelled with the written agreement of North Norfolk Concierge.

7.2         If any costs of Services have already been incurred by North Norfolk Concierge the Customer shall be liable for payment of these items.

7.3         Notice of cancellation should be made in writing via post or email to North Norfolk Concierge.  Notice of cancellation should be given no later than one month prior to the event date save for frustration of the Contract due to the illness, incapacity or death of the Customer or a member of their immediate family.

7.4         The Customer shall be responsible for cancelling contracts they have entered into with any third party suppliers in relation to the event.

8. Damage waiver    

The Customer shall be responsible for adhering to the conditions of any damage waiver of third party suppliers, when entering into direct contracts with the Supplier.

9. Price changes    

North Norfolk Concierge reserves the right to amend prices due to errors or omissions, but such changes shall be notified to the Customer as soon as possible and the Customer shall be able to cancel the booking of the Services if the amended prices are significantly higher than the original price quoted.

10. Termination    

10.1         The Customer may terminate a Contract by giving not less than 30 days’ notice in writing to North Norfolk Concierge.  The deposit shall be refunded less any expenses already paid out by North Norfolk Concierge.

10.2         North Norfolk Concierge may terminate the Contract by giving 30 days’ notice in writing to the Customer.

11. Liability    

11.1         North Norfolk Concierge will not be liable for any act, neglect, or default on the part of the Customer or any other person not within their employ or otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the Customer or any other person may suffer or incur arising out of, or in any way connected with, the Services unless North Norfolk Concierge is responsible. 

11.2         Nothing in these clauses excludes or limits the liability of North Norfolk Concierge or the Customer for death or personal injury caused by North Norfolk Concierge’s or the Customer’s negligence or for any matter which it would be illegal for North Norfolk Concierge or the Customer to exclude or attempt to exclude their liability.  

12. Force majeure    

North Norfolk Concierge shall not be in breach of the Contract nor liable for delay in performing, or failure to perform, any of its obligations under the Contract if such delay or failure result from events, circumstances or causes beyond its reasonable control.  In the instance of a Force majeure or Covid-19 Waiver event, the Services will pause and restart in accordance with any mandatory measures introduced by the Government and at a time and date agreed between the North Norfolk Concierge and the Customer.

13. Covid-19 waiver    

13.1         Neither party shall be in breach of the Contract nor liable for delay in performing, or failure to perform , any of its obligations under the Contract caused by or arising from or in relation to a Covid-19 or similar epidemic or pandemic, including (but not limited to):

13.1.1      Absences or unavailability of staff at North Norfolk Concierge;

13.1.2      Cancellation of the event by the Customer or any other person due to  restrictions imposed by the Government; 

13.1.3      Any illness, quarantining, shielding or self-isolation (including, but not limited to, precautionary self-isolation) of North Norfolk Concierge or the Customer, where the decision to quarantine or self-isolate is recommended or mandated by the Government;

13.1.4      Any recommended or mandatory measures introduced by the Government intended to prevent or delay the spread of Covid-19.

            Each party shall notify the other party as soon as is reasonably practical (and in any event no later than 5 working days) after becoming aware of any Covid-19 event that prevent or delay the performance of any obligations under the Contract.

14. Complaints   

14.1         All complaints must be notified to North Norfolk Concierge as soon as reasonably practicable, as North Norfolk Concierge may be required to carry out an on-the-spot investigation.

14.2         If North Norfolk Concierge is denied the opportunity to investigate the complaint within a reasonable time or denied the opportunity to put matters right, then the Customer will waive all rights.  All complaints relating to the Services should be reported on the day of the event.

15. Data and privacy 

Details are contained in the Privacy Policy located on the website.

15.1         In making a booking for Services, North Norfolk Concierge will request personal information such as name, postal address, email address, and telephone number.  The data may be used to inform the Customer about news and information which North Norfolk Concierge think may be of interest to the Customer.  This information will not be passed onto any third parties for the purposes of administration.  By making the booking.

15.2         The Customer is deemed to have consented to the use of personal information for this purpose.

15.3         North Norfolk Concierge is committed to protecting its customers’ privacy and will only use the information it collects lawfully, in accordance with the Data Protection Act 1998.

16. Governing law 

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties agree that the jurisdiction of the English Courts shall apply in any dispute or claim arising out of this contract.
